(5/12 BRIEF) FAQs About Paid Leave Under the American Rescue Plan Act

  1. Are employers required to offer emergency paid sick leave and emergency family medical leave, or can they offer one or the other?

There are differing interpretations of the legislation, but the best practice currently is to offer both types of paid leave to ensure compliance.

  1. If a company voluntarily offers emergency paid sick leave until September 30, 2021, is it required to reset the 80 available ours each employee can take?

Yes. If you voluntarily provide the additional paid level, you must reset a new allot ment of hours to each employee.

  1. Are companies required to offer the full 80 hours per every employee or is it acceptable to provide fewer hours?

The best practice at this time is for employers to provide the full 80 hours to every fullt-ime employee to comply with the law.

  1. What payroll tax credit can the employer receive if the company offers emergency paid sick and family leave?

It depends. You can receive a tax credit for up to 12 weeks of paid family leave. The toal cap for this is $12,000 per employee. The credit per employee is limited to two-thirds of the employee’s regular pay rate, up to a maximum of $200 per day.
